Terms of Service

Effective Date:

These Terms of Service govern your access to and use of the Gallery of Homes website, including its property-search tools, listings, forms, saved searches, alerts, educational materials, and related services.

In these Terms, “Gallery of Homes,” “we,” “us,” and “our” refer to Gallery of Homes Real Estate Group. “Site” refers to GalleryOfHomesMN.com and any related webpages, tools, forms, or services operated by Gallery of Homes.

By accessing or using the Site, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site.

1. Website Purpose

The Site provides real estate information and tools for prospective buyers, sellers, property owners, investors, lenders, asset managers, and other real estate professionals.

Information available through the Site may include:

• Properties offered for sale
• Real estate search and mapping tools
• Saved listings and property alerts
• Buyer and seller resources
• Market information and property estimates
• REO and foreclosure-related services
• Broker Price Opinion services
• Short-sale and distressed-property information
• Contact, consultation, and service-request forms

The Site is intended to provide general information and a way to contact Gallery of Homes. It does not replace a written real estate representation agreement, listing agreement, purchase agreement, service agreement, or other binding contract.

2. No Agency Relationship Created by Website Use

Visiting the Site, searching for properties, creating an account, submitting a form, requesting information, or communicating with Gallery of Homes does not by itself create a broker-client, agency, fiduciary, or other professional relationship.

A real estate agency relationship is created only through a separate written agreement signed by the appropriate parties.

Information submitted through the Site does not create an obligation for Gallery of Homes to represent you, list a property, prepare a Broker Price Opinion, provide valuation services, or perform any other service.

3. Real Estate Listing Information

Property listings may be supplied by multiple listing services, property owners, listing brokers, government records, vendors, lenders, asset managers, or other third parties.

Although we work to present useful and timely information, we do not guarantee that listing information is complete, current, or free from error. Property details may change without notice, including:

• Price
• Availability
• Property status
• Taxes
• Assessments
• School information
• Measurements
• Square footage
• Lot size
• Zoning
• Property condition
• Financing eligibility
• Homeowners association information
• Included fixtures or personal property

A property appearing on the Site may already be under contract, temporarily unavailable, withdrawn, sold, or otherwise no longer available.

Users should independently verify material property information before making a purchase, sale, investment, or financing decision. Photographs, maps, property boundaries, room dimensions, and similar materials are for general reference and may not be exact.

Nothing on the Site constitutes an offer to sell or lease real estate. Any offer, acceptance, counteroffer, or other transaction must be completed through the appropriate written documents.

4. MLS and Data-Provider Restrictions

Certain listing information displayed on the Site may be protected by agreements with multiple listing services, real estate boards, brokers, licensors, and data providers.

You may use listing information for your personal, noncommercial evaluation of real estate. Unless expressly authorized in writing, you may not:

• Copy or republish substantial portions of listing data
• Create a competing property database
• Scrape, harvest, mine, or automatically extract information
• Use bots, crawlers, or automated tools to access listing content
• Remove copyright, attribution, or ownership notices
• Sell, license, distribute, or commercially exploit listing data
• Misrepresent the source, status, or accuracy of a listing

Listing information may be removed or modified when required by an MLS, listing broker, property owner, data provider, court order, or applicable law.

5. Accounts, Saved Searches, and Alerts

Some Site features may allow you to register an account, save properties, receive alerts, or store search preferences.

You are responsible for:

• Providing accurate registration information
• Maintaining the confidentiality of your password
• Restricting access to your account
• Keeping your email address and contact information current
• Notifying us if you suspect unauthorized account activity

You may not create an account for another person without authorization or use another person’s account.

Property alerts and saved-search notifications are provided as a convenience. We do not guarantee that alerts will be delivered immediately, that every matching property will appear, or that a property will remain available after an alert is sent.

We may suspend or close accounts that violate these Terms, create security concerns, or remain inactive for an extended period.

6. Forms and Information You Submit

When you submit a form, request information, upload material, or otherwise communicate through the Site, you represent that:

• The information you provide is accurate to the best of your knowledge
• You are authorized to provide the information
• Your submission does not violate another person’s rights
• You are not using the Site for fraud, harassment, spam, or an unlawful purpose

You retain ownership of information and materials you submit. You give Gallery of Homes permission to receive, store, review, reproduce, and share that information as reasonably necessary to respond to your request, provide services, coordinate with agents or service providers, comply with legal obligations, and operate the Site.

Please do not submit confidential financial records, Social Security numbers, account passwords, wire instructions, or other highly sensitive information through a general website form unless we specifically request it through an approved secure method.

7. Communications, Email, and Text Messages

When you provide your email address or phone number, you authorize Gallery of Homes to respond regarding your inquiry, requested services, property interests, appointments, transactions, or account activity.

Text-message frequency may vary. Message and data rates may apply.

You may opt out of text messages by replying STOP. You may request assistance by replying HELP or contacting Gallery of Homes directly.

Consent to receive text messages is not a condition of purchasing property or entering into a real estate agreement.

Opting out of text messages does not prevent us from contacting you by another method when reasonably necessary to respond to a pending request, administer an existing transaction, or comply with a legal obligation.

Our collection and use of personal information are also governed by our Privacy Policy.

8. Market Information, Calculators, and Estimates

Market reports, price guides, mortgage tools, calculators, automated estimates, comparable-property information, and other projections are provided for general informational purposes.

These tools may rely on assumptions, third-party data, public records, or information that is incomplete or outdated. Results are estimates only and should not be treated as:

• An appraisal
• A Broker Price Opinion
• A formal comparative market analysis
• A loan approval
• A title report
• A property inspection
• An insurance quote
• A tax determination
• A guarantee of market value
• A guarantee of future sale proceeds

Actual values, payments, closing costs, interest rates, taxes, insurance premiums, commissions, repair costs, and other transaction expenses may differ substantially.

9. REO, BPO, Foreclosure, and Short-Sale Information

Information concerning REO properties, foreclosures, loan defaults, Broker Price Opinions, relocation assistance, and short sales is provided for general informational purposes.

Every distressed-property matter is different. Requirements and outcomes may depend on the lender, investor, loan servicer, insurer, government agency, court, property condition, applicable law, and the homeowner’s individual circumstances.

Gallery of Homes cannot guarantee:

• Approval of a short sale
• Acceptance of a purchase offer
• Approval of relocation assistance
• A particular property valuation
• A lender or servicer response time
• Suspension or cancellation of foreclosure activity
• Deficiency forgiveness
• Tax treatment
• Credit-reporting results
• The availability of a particular loss-mitigation option

Submitting information through the Site does not stop a foreclosure, extend a redemption period, postpone a sale date, modify a loan, or create an agreement with a lender or loan servicer.

Homeowners facing foreclosure or financial hardship should promptly consult qualified legal, tax, financial, and housing-counseling professionals.

10. No Legal, Tax, Financial, Lending, or Inspection Advice

Gallery of Homes provides real estate brokerage and related real estate services. Unless expressly stated in a separate written agreement, we do not provide legal, tax, accounting, lending, insurance, engineering, environmental, surveying, or property-inspection services.

Content on the Site should not be relied upon as professional advice in those areas.

You are responsible for consulting appropriately licensed professionals regarding matters such as:

• Contracts and legal rights
• Foreclosure and redemption deadlines
• Tax consequences
• Financing and loan qualification
• Property boundaries
• Zoning and permitted uses
• Structural condition
• Environmental hazards
• Insurance coverage
• Title defects
• Well, septic, shoreline, and land-use requirements

11. Fair Housing and Lawful Use

Gallery of Homes supports equal housing opportunity and provides services without unlawful discrimination.

You may not use the Site to create, submit, publish, or communicate content that discriminates against or expresses an unlawful preference based on a protected characteristic.

You may not use the Site to:

• Violate any law or regulation
• Submit false or misleading information
• Impersonate another person or organization
• Attempt to gain unauthorized access to the Site
• Introduce viruses, malware, or harmful code
• Interfere with Site security or performance
• Harass agents, property owners, users, or staff
• Send unsolicited advertising or bulk messages
• Collect personal information about others without authorization
• Use Site content for fraudulent or deceptive activity

12. Third-Party Websites and Services

The Site may contain links to or integrations with third-party websites and services, including mapping tools, mortgage resources, social media platforms, multiple listing services, scheduling systems, analytics providers, and other vendors.

Gallery of Homes does not control those third parties and is not responsible for their content, availability, privacy practices, security, pricing, products, or services.

A link or integration does not mean that Gallery of Homes endorses or guarantees the third party. Your use of a third-party service is governed by that provider’s own terms and policies.

13. Website Content and Intellectual Property

Except for content owned by third parties, the Site and its original content—including text, design, branding, graphics, photographs, videos, downloads, page layouts, and software—are owned by or licensed to Gallery of Homes and are protected by intellectual-property laws.

You may view, print, or save reasonable portions of Site content for your personal, noncommercial use.

You may not reproduce, modify, republish, distribute, sell, frame, mirror, or create derivative works from Site content without prior written permission, except where expressly permitted by law.

“Gallery of Homes,” associated logos, and related branding may not be used in a way that suggests sponsorship, endorsement, affiliation, or authorization without written permission.

14. Website Availability and Security

We work to maintain a useful and secure website, but we do not guarantee uninterrupted access.

The Site may occasionally be unavailable because of maintenance, software updates, hosting issues, data-provider interruptions, security concerns, internet failures, or circumstances beyond our control.

We may modify, suspend, restrict, or discontinue any Site feature at any time. We are not obligated to preserve any particular feature, account, saved search, alert, listing, or item of content indefinitely.

No method of internet transmission or electronic storage is completely secure. You use the Site and transmit information at your own risk.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.

Gallery of Homes does not make warranties, express or implied, regarding:

• The accuracy or completeness of Site content
• The availability or condition of any property
• The uninterrupted operation of the Site
• The delivery of alerts or communications
• The absence of errors, viruses, or harmful components
• The suitability of information for a particular purpose
• The outcome of any real estate transaction or service request

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, this section applies only to the extent permitted by law.

16. Limitation of Liability

To the fullest extent permitted by law, Gallery of Homes and its owners, brokers, agents, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of—or inability to use—the Site.

This includes damages arising from reliance on listing information, missed alerts, unavailable properties, third-party services, unauthorized access, data loss, or decisions made using general Site content.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

17. Indemnification

You agree to defend, indemnify, and hold harmless Gallery of Homes and its owners, brokers, agents, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and reasonable legal fees arising from:

• Your misuse of the Site
• Your violation of these Terms
• Information or material you submit
• Your infringement of another person’s rights
• Your violation of applicable law

This obligation does not apply to the extent a claim results from the negligence or unlawful conduct of Gallery of Homes.

18. Changes to These Terms

We may update these Terms periodically to reflect changes in the Site, our services, legal requirements, or business practices.

The revised Terms will be posted on this page with a new effective date. Changes apply prospectively from the effective date unless applicable law requires otherwise.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.

Any dispute relating to these Terms or use of the Site that cannot be resolved informally will be brought in a court with appropriate jurisdiction in Minnesota, unless applicable law requires another location.

20. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

A failure by Gallery of Homes to enforce a provision does not waive our right to enforce that provision later.

21. Entire Agreement

These Terms and the Privacy Policy constitute the agreement between you and Gallery of Homes regarding use of the Site.

Separate written agreements governing brokerage representation, property listings, purchases, sales, valuations, vendor work, asset management, or other professional services take precedence over these Terms with respect to those services.
